These Terms and Conditions (the "Terms") govern the use of the travel portal visitsangemini.com and the publishing service for local businesses delivered through the Horizon Studio platform (the "Service"), accessible exclusively via browser.

2. Definitions
- "Portal": the visitsangemini.com website, with its editorial tourist content.
- "Service": the Horizon Studio publishing platform and its related features (author page, article publishing, business directory), accessible via browser without any application to download.
- "Visitor": anyone browsing the Portal without an account.
- "Partner" / "Client": the natural or legal person who owns or represents a business and who subscribes to a plan and uses the Service.
- "Plan": the subscription chosen by the Partner from those available (Base, Premium, Premium Plus).
- "Dashboard": the management interface (Horizon Studio) accessible to the Partner after authentication.
- "Creem": the payment provider acting as Merchant of Record for subscriptions, invoices and refunds.
3. Acceptance of the Terms
By accessing and using the Service, the User accepts these Terms in full. Acceptance takes place:
- On first opening the platform, through explicit acceptance via a mandatory consent modal (acceptance is recorded with date and time);
- Upon purchasing a Plan, with explicit confirmation;
- Through continued use of the Service after any updates to the Terms.
The User declares that they have read, understood and fully accepted these Terms, the Privacy Policy and the Refund Policy before proceeding with registration and purchase.
4. Service Description
visitsangemini.com is an independent travel portal dedicated to the area of San Gemini (TR): guides, events, history and resources for those visiting the village. Local businesses are offered the opportunity to sign up and build their own presence on the portal, publishing content in front of those planning their visit.
Main features
- Creation of the business's author page / landing page with a block builder (hero, profile, articles, text, buttons, social contacts);
- Publishing of articles, posts, services and offers with images, badges (Promo, Free, New, Hot), custom call-to-actions (label and link) and attached PDF documents;
- Public business directory with opt-in visibility (sec. 10);
- Basic automatic SEO (meta tags and Open Graph) and an interface available in 13 languages, with automatic browser language detection;
- View and like counters;
- Cookieless site statistics via Umami (anonymous and aggregate, with no cookies or banners).
The specific features vary according to the Plan subscribed.
5. Registration and Account
Access to the Service is through automatic account creation following the purchase of a Plan via the payment provider Creem. There is no separate registration form: the account is created using the data automatically received via the Creem APIs (email address, name and country, where applicable; see Privacy Policy, sec. 2.4); the password is chosen by the user in the subsequent guided procedure and stored in encrypted form. Access is reserved exclusively for adults (18+).
Requirements
- Being of age (at least 18 years old);
- Providing a valid email address during the payment process;
- Completing the login credentials (password) through the guided procedure following account creation.
Security and credentials
The User is solely responsible for the security of their credentials. The Owner is not responsible for the loss, disclosure or misuse of credentials by third parties. The User undertakes to promptly report any unauthorised use of their account.
Protection against unauthorised access
After an excessive number of failed login attempts for the same username, access to that account is temporarily blocked (5 attempts → 10-minute block). Monitoring is based exclusively on the username and not on the IP address. The measure is automatic and serves to prevent unauthorised access.
6. Member Area · Horizon Studio
The Partner's member area coincides with Horizon Studio, the management dashboard accessible after authentication, never passing through technical administration panels.
Through Horizon Studio the Partner can:
- Create, edit, publish and unpublish articles (with featured image, badges, external CTAs and attached PDF documents);
- Customise their author page: avatar, cover image, bio, display name, colours, fonts and blocks;
- Manage their visibility in the public directory (sec. 10);
- View and manage the subscription through the Creem billing portal.
7. Partner Obligations
The Partner undertakes to:
- Accuracy of data: ensure that the business information (name, category, contacts, address) is complete, accurate and up to date;
- Responsibility for promotional content: be solely responsible for the truthfulness, compliance and legality of badges (e.g. "Promo", "New", "Hot", "Free"), labels, prices, texts and call-to-actions configured in their content. The Owner is not responsible for misleading labels, outdated prices or claims that do not comply with advertising and consumer law;
- Respect for third-party rights in the images, texts and materials published.
8. Conditions of Use
Permitted use
The Service is intended for local businesses (tourism, accommodation, food service, experiences, crafts and related sectors) to promote their offer in a correct and transparent manner.
Prohibited activities
- Using the Service for unlawful, fraudulent or harmful activities;
- Infringing third-party intellectual property rights;
- Distributing malware, spam or harmful content;
- Attempting unauthorised access to the Service's systems;
- Inserting, through custom HTML blocks or other features, malicious code, trackers or scripts that violate applicable law, third-party rights or these Terms;
- Embedding Portal pages in third-party sites or apps via iframes or similar technologies without the Owner's written authorisation.
The Owner is not responsible for misuse of the Service by the User and reserves the right to remove infringing content, pursuant to sec. 13.
9. Plans, Subscriptions and Payments
Available plans
The Service is offered through monthly subscriptions. The plans currently available are described on the Plans and pricing page:
- Base: business landing page with customisable blocks, automatic SEO, interface in 13 languages, address, categories, contacts and listing in the partner business directory;
- Premium: everything included in Base, with publishing of articles, posts, services and offers also in multiple language versions, up to 4 publications per week, attached PDF documents, badges (Promo, Free, New, Hot) and call-to-actions with custom label and link;
- Premium Plus: everything included in Premium, with unlimited publications and priority support.
Prices exclude VAT; the subscription is monthly and can be cancelled at any time. Prices may change over time; the price in force published on the dedicated page applies.
Payment management
Payments are managed by Creem as Merchant of Record (MoR), legally responsible for international VAT and sales tax handling. Creem handles payment processing, invoice issuance and applicable tax obligations.
Renewal
Subscriptions renew automatically at the end of the current period, unless cancelled as provided in sec. 11.
Downgrade and plan changes
When switching to a plan with fewer features, some features of the previous plan may no longer be available and configurations not provided for by the new plan may be deactivated. It is advisable to note down your configurations before changing plan; the Owner is not responsible for loss of configuration data resulting from the plan change.
Suspension and data retention
If a subscription is suspended for any reason (non-payment, expired or declined card, cancellation), the account automatically enters the 30-day grace period described in sec. 11, at the end of which definitive deletion occurs.
Free accounts
Accounts without an active paid plan (activated free of charge, promotionally or manually by the Owner) are provided at the Owner's discretion, with no right to continued use of the Service; the Owner may suspend or delete them at any time, even without notice, with no refund or compensation due.
Price changes
- Notice: price increases are communicated with at least 30 days' notice by email to the registered address;
- Current period: the new price does not apply to the period already paid; it takes effect from the first subsequent renewal;
- Right to cancel: in the event of an increase, the Client may withdraw without penalty before it takes effect, with access to the Service until the end of the paid period;
- Promotions: promotional prices are temporary; at the end of the promotion the ordinary price applies.
Service communications
The Owner communicates with Partners for service purposes (changes to the Terms, maintenance, service status, security notices) via banner in the dashboard and, where necessary, by email. These communications are operational in nature and do not constitute marketing.
10. Public Directory and Visibility
Directory visibility ("page visible to everyone")
The appearance of your page in the public business directory is governed by a dedicated switch, off by default:
- Activation is opt-in and requires explicit consent on first activation; consent is recorded with date and time and can be consulted;
- Consent can be withdrawn at any time from the member area: the page leaves the directory;
- Published articles and the author page, reachable directly, remain public in any case.
Business address
The Partner may optionally enter their business address: it is shown on the public page with a "Directions" button that opens Google Maps. Opening the map is a Visitor-initiated action. The Partner is responsible for the accuracy of the published address.
Articles and promotional content from businesses
Articles and content published on the blog by member businesses constitute commercial communications of the Partner and not independent editorial content of the Portal. Any business's content is always identifiable through the author (name and business page) and any recognition labels, so as to ensure maximum transparency towards the Visitor and clearly distinguish promotional content from editorial content, as required by law on commercial communication. The truthfulness, accuracy and lawfulness of such content are the exclusive responsibility of the Partner, who indemnifies the Owner under sec. 22.
11. Withdrawal, Refunds and Cancellation
Refunds, the right of withdrawal and the related conditions are managed by Creem as Merchant of Record, in accordance with the Refund Policy, which forms an integral part of these Terms.
Cancelling the subscription
The subscription can be cancelled at any time:
- Cancellation carries no penalty;
- The Service remains active until the end of the current period already paid;
- Refund eligibility is governed by the Refund Policy and determined by Creem.
How to cancel
- Via Creem: "Manage subscription" link in the payment confirmation email, or creem.io;
- From the account area: the section dedicated to subscription management;
- By email: request to support@visitsangemini.com with your identifying details.
Account deletion
To permanently delete the account you must first cancel the subscription or let it lapse. From cancellation or expiry, a 30-day period begins during which:
- The platform and all its features are completely inaccessible;
- Data is temporarily retained for possible restoration;
- Renewal within 30 days automatically cancels the deletion and returns the account to fully active, with all its content.
Termination by the Owner
The Owner reserves the right to terminate the contract and deactivate the account in the event of: serious breach of the Terms; unlawful or fraudulent activity; non-payment. Refund eligibility remains governed by the Refund Policy; data is deleted according to the timing set out in this section. Early account deletion may also be requested by writing to support@visitsangemini.com.
12. Intellectual Property and Copyright
Code and platform
The source code, design and all components of the Horizon Studio platform and of this website are the exclusive property of the Owner. Any form of duplication, copying, modification, reverse engineering, distribution or transfer to third parties is prohibited, as is use outside the Service provided.
Partner materials
Photos, logos, texts and any other material supplied by the Partner remain the exclusive property of the Partner. The Owner uses such materials solely to provide the Service. The Partner is granted a non-exclusive, non-transferable licence to use the platform for the duration of the Plan subscribed.
Third-party trademarks
References to the Municipality of San Gemini, the Carsulae archaeological park, the Terme di San Gemini, the Sangemini brand and any other trademarks mentioned in the Portal are descriptive in nature; the trademarks belong to their respective owners.
13. User-Generated Content
The Partner is solely responsible for the content published through the Service (texts, images, prices, links, attached documents).
The Owner is not responsible for content that violates these Terms, applicable law or third-party rights, and reserves the right to remove any content that, in its unquestionable judgement, is in breach, without notice and without obligation to compensate.
Indexing and visibility of content
Published content is publicly accessible and, as such, may be indexed by search engines, web crawlers and artificial intelligence agents according to the normal dynamics of the web. The Owner neither guarantees nor excludes such indexing.
Language versions
The 13 languages available apply to the Service interface and do not constitute an automatic translation service. The Partner is solely responsible for the creation and accuracy of every language version of their content.
Reports
In the event of reports of unlawful content or content infringing third-party rights, the Owner will proceed with prompt removal after verification. The User undertakes not to publish unlawful, defamatory or obscene content or content infringing third-party rights.
14. Third-Party Content and External Links
Articles and business pages may contain external links (business website, bookings, social media, maps). The Owner is not responsible for the content, availability, accuracy, privacy policies and terms of the third-party sites reached.
15. Limitation of Liability
The Owner's liability is limited exclusively to the operation of the Portal and the services directly provided through the platform. The Owner is not responsible for:
- User-generated content (sec. 13);
- Third-party content and services reached via external links (sec. 14);
- Accuracy of opening hours, prices and information published by businesses;
- Inaccuracies, omissions or lack of updating of the Portal's informational and educational content (guides, historical notes, descriptions of places, events, practical information), provided without any guarantee of completeness or updating;
- Malfunctions due to force majeure (sec. 17);
- Misuse of the Service or loss of credentials;
- Indirect, incidental or consequential damages arising from use of the Service;
- Any downtime caused by server infrastructure providers, while committing to restoration in the shortest possible time.
16. Service Availability and Maintenance
The Owner undertakes to ensure the highest possible availability of the Service, while not being able to guarantee uninterrupted access.
- Scheduled maintenance: communicated with reasonable advance notice by email and/or via a notice in the platform, scheduled to minimise impact;
- Extraordinary maintenance: in the event of technical emergencies or security vulnerabilities, the Service may be suspended temporarily without notice, with restoration as soon as possible;
- The Owner is not responsible for damages arising from temporary unavailability due to maintenance.
17. Force Majeure
Neither party shall be liable for delay or non-performance arising from events of force majeure, including: natural catastrophes, epidemics, pandemics, war, acts of terrorism, civil disorder, interruptions of networks or infrastructure beyond the Owner's control, government measures and cyber-attacks of such scale as to compromise the infrastructure. Should an event last longer than 60 consecutive days, either party may terminate the contract without entitlement to compensation.
18. Protection of Minors and Age of Majority
Registration and use of the Service by minors is prohibited. In the event of registration by a minor, the Owner reserves the right to immediately suspend the account without notice; refund eligibility is governed by the Refund Policy.
19. Dispute Resolution
For any dispute arising from these Terms, the parties undertake to first attempt an out-of-court settlement by contacting support@visitsangemini.com.
ADR / ODR
Consumer Users may resort to online dispute resolution (ODR) platforms pursuant to EU Regulation no. 524/2013, accessible through the European Commission's portal.
Jurisdiction
In the absence of an out-of-court settlement, the Court of Modena shall have jurisdiction over any dispute, without prejudice to the jurisdiction of the Justice of the Peace for lower-value claims.
20. Changes to the Terms
- Material changes (economic conditions, features, plan limits, liability): communicated with a minimum of 30 days' notice by email and published on the platform. The Client has the right to withdraw without penalty within 30 days of notification, with access to the Service until the end of the paid period;
- Formal or corrective changes: effective immediately upon publication;
- No retroactive effect: changes have no retroactive effect; continued use after entry into force constitutes acceptance;
- Data protection: changes affecting the processing of personal data entail updating the Privacy Policy and, where necessary, requesting new consent pursuant to Article 7 GDPR.
21. Governing Law and Contacts
These Terms are governed by Italian law.

22. Indemnification
The Client undertakes to indemnify and hold harmless the Owner from any claim, damage, loss, cost and expense (including reasonable legal fees) arising from: breach of these Terms; publication of unlawful content or content infringing third-party rights; violation of applicable law, including data protection law; misuse of the Service. The Owner reserves the right to participate in the defence of any dispute covered by this clause.
23. General Provisions
- Entire agreement: these Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between the parties;
- Severability: the possible invalidity of one provision does not prejudice the validity of the remaining ones;
- Waiver: any tolerance of a breach does not constitute a waiver of rights; every waiver must be express and in writing;
- Survival: the clauses on Intellectual Property (sec. 12), Limitation of Liability (sec. 15), Indemnification (sec. 22), Dispute Resolution (sec. 19) and Governing Law (sec. 21) survive termination;
- Assignment: the Client may not assign the rights and obligations arising from these Terms without the Owner's prior written consent;
- Communications: all communications take place in writing by email to support@visitsangemini.com or to the address registered by the Client.
